These Terms and Conditions govern the supply of goods sold by us (Love Radiators) to you (the customer). By accessing this website and/or placing an order you agree to be bound by these terms and conditions.

PLEASE READ OUR TERMS AND CONDITIONS CAREFULLY. Using this website indicates that you accept these terms regardless of whether or not you choose to register or order with us. If you do not accept this, please do not use this website.

 

Our Contract

1.1 All orders placed by you; via our website, by telephone, in our showroom or by any other such other means we may permit, are subject to acceptance by us either (as applicable):

  • by dispatch of the goods to you.
  • by providing the goods purchased to you at the trade counter.

1.2 The point of dispatch is the point at which a legally binding contract is constituted between you and us.

1.3 The processing of your payment and acknowledgment of your order (including email confirmation that your order is being processed) does not constitute legal acceptance of your order.

1.4 We shall have no liability to you for failure or delay in supply or for damage or defect to goods supplied in any case that is caused by any event or circumstance beyond our reasonable control.

1.5 If an ‘event outside our control’ affects the performance of our obligations under contract:

  • We will contact you as soon as is reasonably possible to notify you.
  • Where possible we will make alternative arrangements to supply or deliver goods.

 

Ordering

2.1 When placing an order through our website, you will be guided by onscreen prompts. You will have an opportunity to check and amend any errors before submitting your order. Please take time to read and check your order before submission.

2.2 All orders placed are subject to acceptance by us (as described in 1.2). We will not be obliged to supply goods in circumstances where orders are not accepted by us.

2.3 We may refuse to accept orders if:

  • Payments are unauthorised.
  • Products are no longer supplied by manufacturers.
  • There is a significant delay in the expected delivery date.

2.4 We may also refuse to accept an order if:

  • An obvious price error has occurred where it is clear that either human or computer error has led to pricing at which Love Radiators would not intentionally have formed a contract.
  • A product has been incorrectly described.

2.5 If we refuse to accept your order, we will inform you of this as soon as is practicably possible via telephone or email. If you have already paid, we will refund the full cost of an order or, if applicable part order.

2.6 Where possible, if orders have been refused for pricing or description discrepancies, we will use reasonable endeavours to contact you to ask if you wish to continue with the order at the correct price/description or if you wish to be refunded. We will not continue to process your order until we have your instruction.

2.7 If we are unable to contact you, we will cancel your order and refund the full price paid. We will inform you of the cancellation and its reason via the email address used when placing the order.

2.8 We endeavour to provide approximate product descriptions using information, specifications and images supplied by our manufacturers. Whilst we make every effort to ensure all descriptions are accurate, we advise that you seek technical advice from your qualified installer prior to commencing installation.

2.9 Please note; we will not pay compensation for installation costs that have occurred due to inaccuracies in the description of goods on our site. It is your responsibility to inspect the goods received and ensure their suitability before installation commences.

2.10 It is important for you to be particularly prudent when ‘retro-fit’ installations are required where pipework and/or tiling are already in place. We will not be responsible for costs incurred if plumbing modifications are required.

 

Pricing and Payment

3.1 The price payable for goods which includes relevant discounts is visible on our webpages and at the point orders are submitted.

3.2 We reserve the right, at any time, to make price adjustments to reflect changes in our supplier’s prices or the imposition of taxes or duties. All price updates supersede previous prices and take effect immediately.

3.3 Our website contains a large number of product options. It is always possible that despite our reasonable efforts, a pricing error may occur. If due to human or computer error, there is a published price error or omission within our website, we are entitled to adjust prices accordingly without delay.

3.4 Where pricing errors are obvious and unmistakable and could have been reasonably recognised by you as mispricing, we are not obliged to supply the goods at the incorrect price at which we would not have intentionally formed a contract.

3.5 All goods must be paid for in full on submission of an order. For an order to be accepted by us, we must be able to obtain authorisation of funds. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of the card refuses to authorise your payment we will not accept your order. We are not responsible for the card issuer or bank charging the holder of the card as a result of our processing of your credit/debit card payment in accordance with your order.

3.6 By using a credit/debit card to pay for your order or purchase, you confirm that the card being used is yours or that you are authorised to use it.

 

Delivery

4.1 Delivery charges are listed on each product page and specified during the checkout process. Free delivery applies to the UK mainland only. The classification of 'UK Mainland' is at the discretion of the courier/transport company responsible for transportation of goods purchased.

4.2 To order goods through this website you must be able to accept delivery within the UK. We will deliver products ordered to the address specified for delivery when you made your order. If any of the details you have given us in your delivery address are incorrect, we accept no liability for any items which have not been received.

4.3 Once delivery arrangements have been confirmed with you, you must do all that you reasonably can to ensure delivery takes place at the given time and place. If delivery fails as a result of circumstances within your reasonable control, the cost of any re-delivery shall be borne by you. If we are unable to arrange a date for re-delivery we may cancel your order and refund you the price paid for the goods.

4.4 Couriers will make every effort to deliver goods on time however they and we cannot be held responsible for delayed deliveries which are outside of their control.

4.5 Delivery of an order is completed when we deliver the goods to the delivery address provided by you in the order process. The responsibility for the goods will lie with you from that time and we will not be responsible for their loss or damage after this point.

4.6 Before placing your order, please refer to the expected delivery times as set out on our product webpages. Information regarding delivery times is provided by our suppliers based on their stocked items.

4.7 All goods are subject to availability. Delay in the supply or delivery of goods is at times outside of our control. We are not liable for delays when manufacturers have low/no stock of particular items or when there is a delay in the manufacturing process causing additional lead time until items are restocked.

4.8 Where there is an extension to expected delivery dates, we will use reasonable endeavours to contact you to ask if you wish to continue with the order with a delayed delivery date or if you wish to be refunded.

4.9 In the event that we are unable to contact you to inform you of a significant delivery delay, we will cancel your order and refund the full price paid. We will inform you of the cancellation and its reason via the email address used when placing the order.

4.10 We strongly suggest that you do not schedule or commence any installation work until after you have received your order. We will not compensate for missed appointments due to delays. It is your responsibility to order items in good time, ensure you are in receipt of the goods, check they are suitable for your purposes and do not have any defects or missing parts before booking any installer to commence work.

4.11 Whilst every effort is made to package items to ensure they arrive intact, there is always the slight possibility that fragile items may be damaged during the delivery process. We are not liable for any damage caused during the delivery process.

4.12 It is your responsibility to check the condition of items when they are delivered. You should carefully inspect items for any visible damage or missing items and report this to us within 48 hours of delivery. We recommend taking photographs of the transport label, the box and any damage which will help us to resolve the situation as quickly as possible. Failure to provide notification of transit damage under these conditions will mean we are unable to process a refund or replacement.

 

Returns

5.1 As part of consumer regulations, you have the right to a 14 day 'cooling off period' during which you have the right to cancel an order within 14 days after the delivery date, with a further 14 days to return the product for a refund.

5.2 In such cases, you can only return goods and be refunded if they are:

  • uninstalled and unused.
  • in the original, undamaged packaging (free from any additional labels/writing on the product box itself).
  • suitable for immediate re-sale.
  • returned with shipping arrangements and transportation charges being your responsibility.

5.3 It is your responsibility to ensure care is taken to unwrap and open goods, should there be a need to return them. If items are not repackaged in a re-saleable condition, we are not obliged to provide a refund.

5.4 We reserve the right to refuse cancellation of special order items which includes colour finishes and made to measure sizes which have been made to order. Due to their bespoke nature these items are non-returnable.

5.5 As 'Business to Business' transactions are except from Consumer Contracts Regulations, returns from business customers will be at our sole discretion and may be subject to a restocking fee.

5.6 The provision of this clause does not affect your statutory legal rights as a consumer.

 

Manufacturer warranties and guarantees

6.1 Where products on our website are sold with a manufacturer's warranty or guarantee, you must take any complaint, query or claim directly to the manufacturer. We do not hold any responsibility or liability in connection with any such warranty, guarantee or assurance.

6.2 All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

6.3 Due to the inherent technical nature of the products, all products should be installed by a qualified professional. Installation by an unqualified individual may invalidate a manufacturer warranty. It is imperative that you check the terms and conditions of the manufacturer before proceeding with 'DIY' installation. Neither we nor the manufacturer can be held responsible for any costs incurred as a result of installation by unqualified individuals.

7.1 The content of our website does not constitute legal advice and should not solely be relied upon in making or refraining from making any decision. You use the material on our website at your own discretion

7.2 Our website is provided without any representation or endorsement and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose or compatibility.

7.3 All products listed on our website are intended for use in the UK. We cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK.

7.4 All goods are sold in accordance with manufacturers’ specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

 

Liability

8.1 Our liability for losses you suffer as a result of us breaching this agreement is limited to the purchase price of the product and any losses which are a foreseeable consequence of us breaching the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

8.2 If you purchase goods from us as a consumer (anyone who acts outside the course of their business, trade or profession), to the extent permitted by law, we accept no liability for any:

  • Loss which is not foreseeable. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.
  • Loss which arises when we are not at fault or in breach of these terms and conditions.

8.3 Nothing in these Terms and Conditions is intended to affect your legal rights if you are a consumer, nor is it intended to exclude or limit our liability to you for fraud, fraudulent misrepresentation, for death or personal injury resulting from our negligence.

8.4 If you are a trade customer, we have no liability to compensate you, other than any refund we make under these terms and conditions. We shall not be liable to you for any:

  • Loss of profits, contracts, business opportunities, goodwill, anticipated savings, management or office time and other similar losses, or any business interruptions.
  • Indirect or consequential loss, including but not limited to any loss resulting from the cost of plumbers, contractors, or anyone else involved in the installation of the products.
  • Loss which is not a foreseeable consequence of us being in breach of these terms and conditions or our legal duties.

8.5 Although we aim to provide the best possible service, we make no warranty that the functionality of our website will be uninterrupted, error free or that the website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

8.6 In particular, we disclaim all liabilities in connection with the following:

  • Incompatibility with any of your equipment, software or telecommunications.
  • Technical problems including errors or interruptions of our website.
  • Unsuitability or unreliability of our website.
  • Inadequacy of our website to meet your requirements.

 

Indemnity

9.1 You agree to indemnify and hold Love Radiators and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against us arising out of any breach by you of these terms and conditions or other liabilities arising out of your use of this website.

10.1 Our website may include links to third party websites. Any link to another website is not an endorsement of such a website. If you visit any website via a link on our website you do so at your own risk and acknowledge and agree that we are not responsible for the content or availability of any such sites.

10.2 Any party wishing to link to our website is entitled to do so provided that the conditions below are observed:

  • You do not seek to imply that we are endorsing the services or products of another party unless this has been agreed with us in writing.
  • You do not misrepresent your relationship with this website.

12.2 If any of these terms and conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such term or condition shall be severed and the remaining terms and conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

12.3 If you breach these conditions of use and we take no action initially, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these terms and conditions.

12.4 If you access our website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.
